Zip wires and associated equipment are inherently physical activities involving height, speed, movement and significant forces.
Incorrect design, installation, use, inspection or maintenance of a zip wire system can result in equipment failure, property damage, serious injury or death.
Customers must therefore carefully follow all instructions, specifications, warnings and limitations supplied with our products and any applicable instructions provided by the product manufacturer.
Unless Limitless Zip Wires Limited has expressly agreed in writing to design and/or install the complete system, the customer is responsible for the design, installation, configuration, inspection, maintenance and safe operation of the system into which products purchased from us are incorporated.
In particular, the customer is responsible for:
ensuring that the intended installation location is suitable;
ensuring that trees, posts, structures, anchors and other supports are suitable for the loads imposed upon them;
selecting compatible components appropriate for the intended application;
ensuring that the system is designed and installed appropriately;
following all installation and manufacturer instructions;
observing stated product limits and specifications;
ensuring appropriate clearances and fall areas;
ensuring appropriate supervision of users;
carrying out appropriate inspections and maintenance;
replacing worn, damaged, corroded or otherwise unsuitable components; and
preventing use where the system or any component may be unsafe.
If you do not have the knowledge or competence necessary to design or install a zip wire system safely, you should seek appropriately competent professional assistance.
The sale of an individual component by Limitless Zip Wires Limited does not, by itself, constitute approval or certification by Limitless of the design, construction or safety of the complete system in which that component is subsequently used.
Components must be selected according to their specifications and intended application.
The fact that an individual component is suitable for use in a zip wire or related application does not necessarily mean that it is compatible with every other component, installation or system.
If you are unsure about the suitability of a product, please contact us before purchasing or installing it.
Where you ask us to recommend a product, the quality of our advice depends upon the information you provide.
You should therefore provide accurate and complete information about the intended application.
A recommendation relating to an individual component should not be interpreted as Limitless having designed, inspected or approved the complete system unless we expressly confirm in writing that we have undertaken that responsibility.
Nothing in this section affects any legal responsibility we may have where you have made a particular purpose known to us and reasonably relied upon our advice.
Products must be installed in accordance with the instructions supplied by Limitless and/or the relevant manufacturer.
Installation should only be undertaken by a person with sufficient knowledge, competence and physical ability to carry out the work safely.
Where appropriate, professional advice should be obtained regarding structural supports, trees, ground conditions, anchoring or other safety-critical aspects of an installation.
Products must not be modified, substituted or used outside their stated specifications unless expressly permitted by the manufacturer or Limitless.
A zip wire is not a fit-and-forget product.
Zip wires and their components are subject to wear, weathering, movement, loading and deterioration.
The owner or person responsible for the system must ensure that appropriate inspections are carried out throughout its life.
The system should not be used if there is any doubt about its condition or safety.
Any component showing excessive wear, damage, deformation, corrosion or other deterioration should be removed from service and replaced where appropriate.
The owner or person responsible for a zip wire must ensure that it is used appropriately and within any stated limitations.
Children should be appropriately supervised.
Users should not use a zip wire where their physical condition, behaviour or circumstances make doing so unsafe.
The system must not be deliberately overloaded, misused, altered or used for a purpose for which it was not designed.
Customers and users acknowledge that using a zip wire involves inherent risks associated with a moving recreational activity, including the possibility of falls, collisions and injury.
Those ordinary inherent risks cannot be completely eliminated even when equipment is correctly designed, installed, maintained and used.
This acknowledgement does not exclude or restrict any liability which Limitless Zip Wires Limited cannot lawfully exclude or restrict.
Where Limitless supplies products or components but has not designed or installed the complete zip wire system, we are not responsible for the design or workmanship of the customer's installation or the work of another installer.
Subject to applicable law, we are not responsible for loss or damage caused solely by:
incorrect system design by another person;
inadequate or unsuitable anchors, trees, posts or supporting structures;
incorrect installation by the customer or a third party;
use of incompatible components not specified by us;
failure to follow instructions;
operation outside stated specifications;
inadequate inspection or maintenance;
normal wear and tear;
unauthorised modification;
misuse; or
continued use after a defect, damage or excessive wear becomes apparent.
Nothing in this section excludes responsibility for a defective product supplied by us or for negligent advice, design or installation for which Limitless is legally responsible.
Where Limitless Zip Wires Limited has expressly contracted to design and/or install a complete system, responsibility for that work is governed by the quotation and our separate Installation Terms & Conditions.
The customer remains responsible for appropriate use, supervision, ongoing inspection and maintenance after handover, subject to the terms of the relevant contract and applicable law.
Nothing in this Legal & Safety Notice or elsewhere on our website is intended to exclude or restrict rights or remedies that cannot lawfully be excluded.
Products supplied to consumers must meet the standards required by applicable consumer law.
Nothing in this notice excludes or restricts our liability for:
death or personal injury caused by our negligence;
fraud or fraudulent misrepresentation; or
any other liability which cannot legally be excluded or restricted.
